The following Terms and Conditions are between the Customer (hereafter referred to as “you” or “your”) and Sweetest Treasure Ltd (hereafter referred to as “Sweetest Treasure”, “we”, “us” or “our”).

By submitting an order on www.sweetest-treasure.co.uk, you are agreeing to the terms and conditions that appear herein, which will apply to any purchases made throughout this website.

By agreeing to these terms and conditions you confirm that you are;

  1. A registered customer of this website.
  2. Over 18 years of age or have your legal guardians consent to use our website.
  3. Providing accurate and complete details.
  4. Consenting to Sweetest Treasure collecting your information for marketing purposes.

PRIVACY

The use of your personal information is covered by our Privacy Policy that is listed at the bottom of our website.

PURCHASE CONTRACT

All purchases made on Sweetest Treasure’s website are governed by these Terms and Conditions. The Terms and Conditions governing your purchase will be those in effect on the date of your purchase. We reverse the right to amend our Terms and Conditions at any time. If you order goods after we have published any changes to the Terms and Conditions, you will be bound by those changes. Accordingly, you should ensure that you understand the precise Terms and Conditions applicable to your order, before placing your order.

We will confirm receipt of your order as soon as possible by email, to the email address that you have provided to us. Please make sure that the email address that you have provided is correct and accurate and that your email mailbox is in proper working order, as all correspondence regarding your order is sent to the email address provided. Please remember to check your spam or junk mailbox as emails can often be misdirected by your spam filters.

Our acceptance of your order will take place upon payment being received and further contact and updates on your order will be notified by email or updated on your account page. We will supply the product(s) to you in accordance with these Terms and Conditions.

PRICING AND AVAILABILITY

All products ordered are subject to availability. Whilst all endeavours are made to ensure the stock available on the website is true and accurate, some stock in our distribution centre may be damaged or short dated. For this reason, we cannot be held responsible if all or part of your order is unable to be fulfilled, due to any errors in the stock shown as available on the website.

Prices quoted on the website may vary time to time and are liable to change without prior notice. Any price changes will not affect orders that have been checked out and/or paid for.

If you have items in your basket and have not checked out, the prices will be updated as you complete the check-out process. In the event of any obvious pricing errors, we reserve the right to cancel an order before dispatch and refund any monies paid to us. The prices shown will be including VAT.

PAYMENT AND REFUNDS

Payment must be received in full before your order will be dispatched. Payments we accept are shown at checkout when making your final purchase. We reserve the right to refuse any order should it be necessary for any reason and in the event of needing to issue a refund we will endeavour to do so within 10 working days. You have the right to cancel an order before its been despatched, however any Pic N Mix orders cannot be refunded once the mix is ready. Orders can only be amended or cancelled by email. Orders cancelled before preparation is started will be reimbursed using the same method used for payment.

MAKING PAYMENTS & PAYMNET DETAILS

When using our site to make payment we use a 3rd party for this process and for security our site dose not store credit card details nor do we share customer details with any 3rd parties.

The company used for this service is DOJO, which is the trading name of Paymentsense Limited, Paymentsense Ireland Limited and WalkUp Limited.

DOJO have in place a level of security appropriate to the nature of the information we process and the harm that might result from a breach of security. Your information is stored on DOJO’s secure servers. The transmission of any payment transactions will be encrypted using TLS technology. All environments that are used in the processing, storage or transmission of payment card details are PCI DSS compliant and, as a Level 1 Service Provider, our compliance is assessed by an independent Qualified Security Assessor (QSA) on an annual basis. OWNERSHIP OF THE PRODUCT(S)

The title and ownership of the product(s) belong to Sweetest Treasure and shall not pass to the customer until such time as you have paid in cleared funds to our Bank Account. If you receive your order and find there to be issues, you agree to store the product(s) in a safe manner and you agree not to destroy, deface or obscure any identifying mark or packaging on or relating to the goods until such time that the ownership has passed to you.

DISPATCH

We will always endeavour to dispatch on the same working day, any orders that have  been placed and paid for before 2pm Monday to Thursday. However, we cannot always guarantee this. Orders placed and paid for on Friday, Saturday and Sunday will be dispatched on Monday (providing it is not a UK bank holiday) this is so the packages do not sit in our couriers warehouse over the weekend and to ensure your products stay fresh and in line with our hygiene standards. Please contact our team via the contact us page at the bottom of our site should you need any items urgently before you place your order and we will confirm if we can fulfil your request.

DELIVERY

Delivery will be made to the address provided during the check-out process. Please ensure that you have entered your address correctly. We cannot accept any liability for miss-delivery or re-delivery if the delivery address entered on the order is incorrect.

Deliveries will be made between the hours of 8am and 8pm. You must ensure that your delivery address is easily accessible and that someone is available to accept and sign for the delivery. If no one is available to accept and sign for the delivery, a re-delivery charge may be incurred.

The delivery transit times specified at the point of checkout are calculated from the point of dispatch. For example; a 24hr order dispatched on Monday should be delivered on Tuesday, a 48hr order dispatched on Monday should be delivered on Wednesday. The delivery days are Monday to Friday as standard. Therefore, a 24hr order dispatched on Friday should be delivered on Monday and a 48hr order dispatched on Friday should be delivered on Tuesday. Please note that these delivery times are only guidelines and not guaranteed as Sweetest Treasure have no control of the packages once it leaves our site. The delivery is performed by one of our delivery partners, therefore we cannot guarantee a delivery date and accept no liability if the delivery extends beyond the specified timeframe. In the event of delayed delivery or lost parcels, all reasonable efforts will be made by Sweetest Treasure to contact the courier/delivery partner to track the parcel, but you accept that once your order is passed on to the courier/delivery partner that all liability is passed on to the courier/ delivery partner and not with Sweetest Treasure. No refunds, full or partial, will be made by Sweetest Treasure to you, until we have conducted a full investigation and have come to a reasonable conclusion.

NOTE: The above delivery times is based on delivery to UK Mainland and if you live outside of the Mainland zones your parcel may take an two.

DAMAGED PARCEL

If your package is visibly damaged upon arrival, please sign your name and the word damaged, also take a picture or worst case refuse the package.

No liability for damages and or discrepancies will be accepted if the proof of delivery is signed for as received in good condition.

Any discrepancies with the order received must be notified to us in writing to Sweetest-Treasure@outlook.com within 24hrs of receipt. No liability will be accepted for discrepancies notified to use any later than 24hrs after receipt.

SENSITIVE ITEMS

Sweetest Treasure ask that you consider the weather climate when placing an order as any products that are sensitive to heat, and are ordered during the summer months are done so at your own risk. We cannot accept any liability for damage caused in transit due to warm weather. Sweetest Treasure have the right to hold any order we fill may get damaged without any notice to help prevent damage.

SHIPPING OUTSIDE OF THE UK

Sweetest Treasure will make every effort to fill in all paperwork online with the guidelines set in the UK on despatch, however any duties/tax that are added by the receiving country MUST be paid for by the receiver as this is out of our control.

Duties/tax may very on products that are of a NON UK or EU Origin and this will vary depending on the commodity code of the product.

If you do not pay these required charges then the parcel will be returned to us at an extra cost. If your order gets returned to us due to non-payment of customs and duties then you will forfeit the costs of shipping + cost of return when receiving a refund. If the shipping cost and the return cost works out more than your order value Sweetest Treasure have the right to invoice you for the difference and you agree to pay this as part of the agreement between yourself and Sweetest Treasure by placing an order on our site.

CANCELLATIONS –  BEFORE DISPATCH.

Any orders may be cancelled before they are dispatched and a full refund will be issued in this case, however if your order contains a Pick n mix and this has already been mixed, we cannot refund this cost as the sweets  would need to be destroyed as they cannot be returned to stock due to cross contamination reasons. In this case we will contact you and supply an image as proof and you can confirm how you wish to proceed.

CANCELLATIONS –  AFTER DISPATCH.

If you wish to cancel an order that has been dispatched but not yet received the following applies: – If it is a parcel you will need to wait and refuse the delivery or accept delivery and then return the order back us as instructed below in the returns section. A refund will be issued less the original delivery costs and an administration fee of up to £20 may also apply.

ORDER ERRORS

Order errors and or discrepancies must be notified to us in writing to Sweetest-Treasure@outlook.com within 24hrs of the receipt of the order and remember to put your order number as the ref. Our team will then check stock levels and then either refund your missing item or send the items out to you free of charge, before this happens our team will contact you with our findings.

RETURNS

As the items that we sell are perishable we do not accept returns, however please contact us and our team will see if we can assist you further.

DAMAGES

If your order is delivered to you damaged, please contact us immediately in writing by emailing Sweetest-Treasure@outlook.com, please use your order number  as your subject line and detail the damages along with photographic evidence of the damage with the shipping label clearly visible. We will review this evidence before taking further action; refund or replacement.

If your order arrives in a damaged or faulty condition, we will offer a refund for damaged items ONLY IF YOU HAVE SIGNED FOR THE PARCEL AS DAMAGED.

BEST BEFORE DATES

Due to the time it takes for products to be imported to the UK from overseas, there are certain products that may have shorter best before dates than others. We sell with the intention of the customer consuming a product upon receipt, or within 2 weeks of receipt. You accept that products you receive may have a best before date that is no less than 2 weeks away from date of receipt. If you are buying products to keep for a specific occasion or date in the future, then we recommend contacting us via email on Sweetest-Treasure@outlook.com before purchasing to ensure that you receive products with sufficient best before dates. Please note that we may also sell products that have exceeded their best before date, however these will always be marked in the title of the product.

COUPONS/DISCOUNT CODES

Coupons do not apply to sale items.

LIABILITY

If we fail to comply with these terms and conditions we are responsible to loss and or damage you suffer that is a foreseeable result of our breach of these terms and conditions or our negligence, up to the amount of the purchase priced paid by for the products order. Our maximum liability is limited to the total cost of your order. We are not however responsible for any loss or damage that is not foreseeable. Loss and/or damage is foreseeable if it was an obvious consequence of our breach or it was contemplated by you and us at the time you placed the order.

TERMINATION

We reserve the right to terminate your account at any time and restrict access to the website, if there is a risk of loss or liability to us or if there is a reasonable reason for doing so.

If we terminate your account we will refund in full any orders that have not yet been dispatched.

EVENTS OUT OF OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside of our reasonable control, including but not limited to: any act, event, non-happening, omission or accident beyond our reasonable control, examples including:

  • Strikes, lock-outs or other industrial action.
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation of war.
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster.
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
  • Impossibility of the use of public or private telecommunications networks.
  • The acts, decrees, legislation, regulations or restrictions of any government.
  • Non-performance by suppliers or subcontractors.
  • Loss of power to our site of dispatch resulting in no access to our order system.

ERRORS OR OMISSIONS

Any information displayed on this website regarding the products we offer for sale, including, but not limited to; product descriptions, images, sizes, weights, ingredients, nutritional information, and the like, are provided for your convenience only. We cannot be held responsible for any inaccuracies within this information provided and cannot guarantee it to be accurate.

The manufacturers of these products are liable to change or modify any of the above information, without notice, at any time. Whilst we will make all endeavours to ensure that the information displayed is, to the best of our knowledge, accurate, you agree to and must carefully read the product packaging, including ingredients, allergens and any health and safety warnings, before consumption.

In the case of pick n mix where the above is not displayed on packaging, please see the ‘Pick N Mix Ingredients’ page on the footer of our site, once again this is guidance only and to the best of our knowledge and for confirmation please contact us via email at Sweetest-Treasure@outlook.com and our team will check and confirm any questions you may have.

3RD PARTY WEBSITES

Where there are any links to a 3rd party website listed on this website, we do not vet these websites nor do we have any control over the contents. We cannot therefore accept any liability in respect of the use of those 3rd party websites.

WAIVER

If we fail, at any time during the term of the contract, to insist upon strict performance of any of your obligations under any contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from your compliance with such obligations.

A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing by email or recorded letter.

SEVERABILITY

If any of these terms and conditions or any provisions of a contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

ENTIRE AGREEMENT

These terms and conditions and any document referred to in them, represent the entire agreement in relation to the subject matter of any contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing. We each acknowledge that, in entering into a contract, neither party has relied on any representation, undertaking or promise given by the other or to be implied from anything said or written in negotiations between us, prior to such contract, except as expressly stated in these terms and conditions. Neither party shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any contract (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these terms and conditions.

OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

We reserve the right to revise and amend these terms and conditions at any time and without notice. Any changes made to these terms and conditions will be updated on this page. You will be subject to the terms and conditions that were applicable at the time of your order, unless any of the changes are required by law.

THIRD PARTY RIGHTS

No one other than a party to these terms and conditions shall have any right to enforce any of its terms and conditions.

You may not reproduce, copy, duplicate, transmit, publish, display, distribute or sell any material from this website. You may not use this website or its content for any commercial purpose; including the collection and use of any listings, descriptions, prices, make any derivative or commercially exploitative use of this website or its content, download or copy any account information, use any data mining, robots or similar data gathering and extraction tool without the explicit written consent from us. Any unauthorised use terminates any permissions granted.

COMPLAINTS

Should you feel you have not been happy with the service or customer service you have received please email and request for a team of management to contact you, this should happen within 48 hours to help resolve the issue you are having.

PASSWORD AND SECURITY

At the time of registration you will be required to enter a password. You are responsible for maintaining the confidentiality of your password and any activity on your account that occur. We cannot be held liable for any loss or damage which may arise as a result of any failure by you to protect information.

LAW AND JURISDICTION

These terms and conditions will be governed in line with English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise.
